    Judge ruled Newsom violated the Constitution - end to Gavin's one-man rule

    Good news for keeping our rights!

    Today a California Superior Court ruled in favor of me and fellow legislator James Gallagher in our lawsuit challenging Gavin Newsom's abuse of power.

    The Judge ruled Newsom violated the Constitution. She also found good cause for a permanent injunction restraining the Governor from issuing any more unconstitutional orders. You can read the ruling here.

    This marks an end to Gavin Newsom's one-man rule. It makes clear that the laws of the State of California do not countenance an autocracy under any circumstances - not for a single day, and certainly not for eight months with no end in sight.


    The ruling is "tentative," meaning Newsom has a few days to try to persuade the Judge to change her mind, but it's rare for a tentative ruling to change. While Newsom can appeal, we are confident the decision is on solid legal ground and will stand.

    This Kevin Kiley is a damn Republican and of course, he doesn't like anything Gov.Newsom does or says. I don't listen to a Republican for any reason. I am mostly grateful for what the Governor has done so far.

    I don’t see this as “news” to anyone except those that want it to be to try and support their own agenda.

    This was a superior court judge in Sutter county, the second time a judge their has ruled this way. (I’m not sure but I believe on the same issue). The June ruling was almost instantly stayed by the appeals courts.

    I haven’t bothered following this- because the Republicans have been suing Newsom right and left over his actions during Covid. And time and time…and time again- the highest courts in CA have sided with Newsom.

    For background.. this was over an executive order expanding voting access to deal with the realities of Covid. And this suit was largely moot - because lawmakers passed the same thing into law.

    A headline the right loves no doubt, but ultimately- this story, and this decision, are meaningless. And, I’ll doubt Newsom will challenge this ruling because it has no real effect and is from such a minor court the ruling will have no long term impact in the future…and so is not worth the time or money. But if you have followed the many other cases- there is little doubt the higher courts would overturn this ruling.
