    My dog... did you even watch the links? The second is thouroghly bashing whitehouse for his full on conspiracy theories... the first was just giving him the rope to hang himself...

    Perhaps a better discussion would be that until Obamas blocked appointment, with the rare exception that something bad was found, supreme court justices were normally confirmed with 95+ senate votes. Politics didn’t enter into the discussion of qualifications.

    actually, I think politics were definitely a big part of the process. In a good way - given that 'politics' is really just the process of decision-making when people have conflicting interests. It's not like there's gods way and the politician's way, after all.
    but back to my argument: in the good ol' days, the politicking happened before the nomination was put forth. People actually had made compromises and gone through a give-and-take. The Gingrich style of fight-like-a-rabid-dog over every issue wasn't dominant yet, people took a longer view and saw each issue in a broader context. There are a ton of reasons why people who are willing to burn the house down around themselves are getting elected. Some are even morally defensible. But they lead to they type of government interactions we have now.
