    Once again my reality was shaken and I was reminded that life in the United States may seem free, but that concept only applies to a very small part of the world around us and stays that way only as long as you believe and do what you’re told. So this is a saga about my adventures with the “Taxman”, THE FRANCHISE TAX BOARD and the INTERNAL REVENUE SERVICE.

    About two years ago, what I can only say is a fortuitous series of events occurred that forced me make a decision not to file California income taxes in order to make a statement and do what I felt was the right thing to do. What started this adventure was missing paperwork. I had always filed my taxes and always gotten money back so I thought, well I would be saving California money if I didn’t file so I decided not to file just this one time. Well, last year I got a letter from the FTB saying that they didn’t think I had filed a tax return and I had better do that lickety-split or fines, interest and/or liens would rain down on me. Well, these strong-armed tactics just didn’t seem necessary and my independent Spirit just decided to put my foot down and make a statement. After all, couldn’t they be spending all the high salary time on encouraging the big corporations to pay their fair share in what would be a more profitable use of their time?

    I promptly sent THE FRANCHISE TAX BOARD a letter informing them that I would be happy to give them the information they requested if they would show me evidence/facts of “proof of claim” and also show me where the FTB gets its authority and jurisdiction over me, A Sovereign Human Being with free-will, to force me pay income tax to California without my consent. I also asked them to show me evidence of how that tax money is being spent in California to, “…support the infrastructure and services desired by the resident of this state.” (as quoted from a letter from Duncan Adams, Executive and Advocate Services). As a side note, the letter from Mr. Adams didn’t arrive until eight months after the FTB received my letters and my tax filing date he referred in it to was incorrect.

    This idea of contract got me thinking. I recently received a letter (junk mail) from AAA which turned out to be an invitation to contract (an agreement entered into voluntarily and with our full knowledge and consent) with them for life insurance and on the envelope it said, “Signature Requested”. Which then got me thinking that all the services that we are obligated to pay have contracts; auto insurance, life insurance, retirement plans, medical insurance, local contractors and the list goes on. It is very, well unbelievable, that THE STATE OF CALIFORNIA CORPORATION (yep, you read that right) would not need to contract with the people they want to give them a portion of the fruits of their labor and for an undesignated service. Wow! Sounds like fiction… nope! And yes we’ve been doing this all these years just because some elected/appointed official “said so”, which brings to mind the tax return that we have to sign. So perhaps we are giving our consent without knowing it when we sign our voluntary tax return (yes, and you read that right, FTB and IRS expect “The People” to voluntarily submit their hard earned money to them. What this really means is they don’t want to send their enforcement thugs out to force you to do it every year, but they will send their thugs out after a few people just to keep everyone in “fear” and compliance.

    And for those of you out there that are outraged at the thought of someone not paying their fair-share, I challenge you to Google “Grace Commission” and do some research on where the hard earned money goes that you pay in income taxes to the IRS. Almost all, if not all, of the money that Americans pay goes to pay the debt created for the U.S. government and that means all the U.S. Citizens, by the interest charged on paper money printed by THE FEDERAL RESERVE (a private banking Cartel). As for where “The People’s” tax dollars that the FTB collected goes, I have asked them and so far there has been no response. But if you think about it, why do we need that money anyway? I’m still doing research on this, but so far all the services we have in California and in the United States really, are paid for by what seems like a never ending list of excise taxes and fees. Can you think of one service/infrastructure/schools, etc., we have that is funded by your personal income tax? Please let me know if you know of some.

    GOOD JOB for actually talking action after discovering the fallacies. Everything you wrote is correct, but I think your first sentence is especially poignant. We can either lay down out of fear and agree to be lied to and swindled, therefore co-responsible for enabling more corruption and misappropriation, or make your life's legacy having stood up for yourself and your human, legal and ethical rights. Will any of the corruption change if there aren't more people that take action when they wake up? No.

    I also feel that there are no more excuses for being uninformed or in denial. It takes some effort and sifting, but the internet has now put the truth on the table if you take the time to look.

    I learned a lot about the state level fraudulent taxation basis from your post, thank you. I already knew about the Federal Level fraud, which is similar. Here's the factual basis:

    1. Due to Limitations Imposed By The U.S. Constitution, Filing of Federal Income Tax Returns and Payment of Federal Income Tax Is Voluntary, Not Mandatory.
    2. The 16th Amendment To The U.S. Constitution, The Amendment Which Precipitated The Federal Income Tax, Was Never Legally Ratified.
    3. The U.S. Government Finances Its Operations Form the Unconstitutional Creation of Fiat Money, not with Revenue From Income Taxes.

    Basically, having domestic earnings, is not the "subject" of the income tax set forth in the IRC (Internal Revenue Code). Additionally, "employment tax" as distinguished from "income tax" is a voluntary matter as may be corroborated by a read of 26 U.S.C., section 3402(p)(2). Only citizens of the United States of America with foreign earned income are subject to an income tax of 30%. And, this may be found by looking at 26 U.S.C., sections 1461, 1441, 1442 and 1443. The "withholding agent," sec. 1461, may be you or me if qualified by circumstances.
