Need Legal assistance with home foreclosure

I turned 60 this year and I have been fighting foreclosure on my home in Sebastopol for 3 years. I am exhausted on all levels. I am suing the bank for wrongful foreclosure, etc. and have already spent $30,000. on legal fees. My previous lawyers decided that they had a conflict of interest after a year of payments. So, I need a legal Coach to help me finish this lawsuit. A Summary judgment hearing is August 22.

The bank sent a threatening letter to my tenant, so she left abruptly. A week later someone hired by the bank broke into my house ilegally and changed all the locks. So I got my drill out and took them all off and put my own locks back on so that I could get into my home!! There was no unlawful detainer served.

I need a coach who can help with legal rules and procedures. Please help me. This is so wrong. Thank you, Barbara Wilt Please call 707 824 4416.

I am an acupuncturist and would be delighted to offer my expertise in trade for legal help.

There is a group of non-lawyers studying the law. They have much experience with foreclosures and may be of help to you.

They can help provide information regarding other areas of law, including protecting your sovereignty.

There is no cost for these meetings.

E mail George Daniel for info on this group:

    TO ALL:

"The fact is that the average man's love of liberty is nine-tenths imaginary, exactly like his love of sense, justice and truth. He is not actually happy when free; he is uncomfortable,
a bit alarmed, and intolerably lonely. Liberty is not a thing for the great masses of men. It is the exclusive possession of a small and disreputable minority, like knowledge, courage and honor. It takes a special sort of man to understand and enjoy liberty-- and he is usually an outlaw in democratic societies." -- H.L. Mencken, Baltimore Evening Sun, Feb. 12, A. D. 1923.

Barbara's troubles are not just from the real estate collapse. She was also a victim of the Tenant From Hell, which caused her to loose thousands of dollars of rent and cost her thousands of dollars in legal fees.
So if there is anybody out there who can help her, please try to do so!

What city do you live in?
You might get some help from Occupy.
Occupy Petaluma has been working with CJ Holmes on foreclosure issues. She is a real estate broker who has been focusing on this issue.
In Santa Rosa try contacting the Sonoma County Solidarity Network (SoCoSol) at https://socosolidarity.net/. They are part of Occupy Santa Rosa.
There was a study done by the San Francisco City Assessor's Office that discovered that 80% of all foreclosures in SF are fraudulent! The banksters are crooks and getting away with it!
One piece of advise I have heard over and over is don't leave your home! Do not give up! Make them show you the deed! Many of the banksters are pretending to own the house and do not.
    Good luck!

C.J.Holmes never responded to my request for help.Makes me wonder if she is really into stopping real estate fraud and assisting people who are victims...

Thank you for that feedback about CJ Holmes. I don't know her other than her promotions.
I suggest that you contact the Sonoma County Solidarity Network (SoCoSol) at https://socosolidarity.net/ which is part of Occupy Santa Rosa. Occupy Petaluma has been more involved with foreclosures than we have.
    Don't give up!

Re: Need Legal assistance with home foreclosure

I just read that someone contacted me and I didn't reply. I definitely apologize, and ask that you email/call me again. I have been swamped with requests from individuals, all the while I'm trying to create a way to stop foreclosures en masse with class action lawsuits, and will soon be hosting a radio show and a tv show. (radio show this friday, Aug 24 from 10a-11a, and the TV show is on public channel 30 Aug 29 from 3p-4p.)

I also was not aware of how this BB works nor that there is someplace to chat or respond... sorry but I'm still catching up.

The bad news is, pretty much no matter what you do in CA, once the servicer starts foreclosing, you will most likely lose the home. Each case is individual, lawsuits are a huge burden in time, effort and money, and loan modifications are very hard to get, much less getting a good one.

When an owner contacts me, I use the property address to review all the recorded documents on that property, determine if there is anything amiss that I can find, then send the docs with my analysis about their options as I see them.

Every owner is welcome to use my Owner Help page on https://www.hofj.org/, to check to see if their loan is owned by Fannie or Freddie, in which case they can apply for a HAMP loan modification.

I've also got Action Target pages, with Bank, Government contact info for activists to flood with emails and calls to protest an auction.

Please don't hesitate to call me again if you don't get a response the first time. And thanks for understanding. cj
