The Fifth Amendment

States:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

This very Important Basic, Human Right, from the Bill of Rights, an Appendage to the United States Constitution, has been violated, with respect to your neighbor, John Jenkel, the old man down the road, Do you care? Please, weigh in Citizens. Express yourselves....

I, for one do Care, and I also do not care about whatever "bother" John Jenkel may have been up until this point, because he was just speaking his mind, which he has a perfect right to do as a Citizen, because the First Amendment to the Constitution, clearly States:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

People like John Jenkel, who still take the responsibility of Citizenship seriously, are rare these days and should be honored as Elders - even if they do take up time in City Council Meetings...

All I mean to do, is stir up that pure element in your minds, that is, your Consciences, to remember the old truism: "an injury to one is an injury to all." And ask you-all, also to weigh in on the subject of The Fifth Amendment - as it pertains to Property – and the appropriateness or inappropriateness of it all. I mean; we all know that Freedom, and Property are both a bother - but is the bother worth it?

Q. Should we Organize, now, and attempt to do the necessary hard work that it takes to make "Democracy come to the U.S.A.?" - as in that wonderful song we all love by Leonard Cohen?

-Q. Is that even Possible? =OR= Because Apathy is just so general, does even posing the Question betray an incredible, thick, lack of Realism?

Q. Is the Process of "Democracy Coming to the U.S.A." inevitable, as old school Second Internationalists used to believe that Socialism was inevitable?

=OR= Should we just pack it all in & let the Fascists have all of North America, Now, and just find some nice safe place like the high Andes to ride out the Apocalypse with our honey?

The Bill of Rights


Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

Amendment II

Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

Amendment VII

In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law.

Amendment VIII

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Amendment IX

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

These are certainly huge issues that need to be confronted, lolchan, and equally important questions to cogitate. But, frankly, I'm exhausted and a nice, safe place with my Honey sounds freakin' perfect!! Preferably somewhere that has no t.v., no internet, no newspapers, no politicians or lawyers; nor screaming radicals, whining family-members, disgruntled co-workers, evil corporations, perverted religious bigots, neurotic micro-dogs, OCD power saw wielding neighbors at the stroke of 8AM, texting drivers, contaminated lettuce, zombie cashiers, collateral damage, plutonium-laced potato chips, and that weird thing going on with my right hip that I can't get looked into because I can't afford health insurance.

My brain may be stuck in Warp 8 on the information super highway but my nervous system is geared for a small hunter-gatherer tribe of about eight people max (none with cell phones). I should only have to be worried about being eaten by a predator about once a month if I'm lucky and my partial Neanderthal gene is competent. All this crazy bs in the world in every nook and cranny (and while you're looking, don't forget to check for bedbugs!) has my fight-flight button stuck on ON. Hell yeah! Damn straight I'm ready to opt for the Andes!

The Bill of Rights was written to prohibit certain, specific wrongs that are traditionally committed by Governments.

Rights are the opposite of Wrongs. When we say "Rights", we mean we are prohibiting certain recognized "wrongs".

Yes, it's just as relevant today since Governments continue perpetrating those wrongs, our own increasingly so.

The Bill of Rights is only as effective as The People are willing to stand up for them. When wrongdoing occurs, The People must use whatever force is necessary to defend their Rights. Otherwise, they have no Rights.

As an example, how is it possible that "shall not be infringed" has turned into an endless series of permit requirements, taxes and restrictions?

How is it possible that "congress shall make no law" has turned into government prohibition of religious expression?

The Crux of the Matter :

Amendment IX

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

These two Amendments are quite brief, and concise, really - but they are Enormous, in their implications of the inherent Power that is vested in the Sovereignty and Collective of the People. We need to be mindful of our inherent Rights - as they are enumerated in the Bill of Rights, and also as they exist in the Divine and Natural Realms.

We need to Learn how to Assert and Express our Inherent, Civil, Divine, and Natural Rights. Also, we need to Learn how to fight back against the Plutocracy, who have been very busy for decades and decades, dumbing us down, keeping us divided, and whittling away at our Sovereign, inherent Rights.
