    Roblar Road Quarry Update: Hearing on Wed. June 8

    FYI: Forward from Sue Buxton: Good News and Update about CARRQ :

    Last week Superior Court Judge Daum tentatively denied Roblar Road quarry owner John Barella’s motion to disqualify CARRQ’s pro bono law firm. Judge Daum will hear arguments from Barella’s attorney opposing his ruling on Wednesday, June 8, at 3 p.m. in Superior Court (3035 Cleveland Avenue in the Empire College complex), Department 16. Please attend the hearing to help show your support for CARRQ and our need to keep our pro bono lawyers.

    Judge Daum's ruling affects two cases:

    6. 248943 - Citizens Advocating v. County of Sonoma Real Party in Interest John Barella's motion to disqualify Counsel is denied. Mr. Barella was never a client of Morgan, Lewis & Bockius LLP. Even if Mr. Barella gave personal confidential information to a partner of the firm in January of 2009, such information was not related to the dispute in this case. Real Party In Interest will suffer no harm if this motion is denied. However, Petitioner will suffer harm if this motion is granted because it is unlikely that it will find another law firm to take its case on a pro bono basis.

    7. 249021 - Tresch v. County of Sonoma Agricultural Preservation and Open Space Real Party in Interest John Barella's motion to disqualify Counsel is denied. Mr. Barella was never a client of Morgan, Lewis & Bockius LLP. Although Mr. Barella spoke to Mr. Stephen Finn of the firm, Mr. Barella did not personally retain the firm and did not give Mr. Finn any confidential information that was substantially related to the dispute in this case.

    CARRQ update on the June 8 Superior Court Hearing

    CARRQ supporters nearly filled the court room on Wednesday as quarry owner John Barella's lawyer argued against the tentative ruling made last week by Superior Court Judge Daum denying Barella's motion to disqualify our pro bono law firm:

    The judge did not issue a final ruling yet, saying he would review the case and respond by the end of the week. We’ll keep you posted!!
