Hello, Does anyone know if there is a new access to the riverfront beach owned by Korbel down by the end of Drake Rd and Southern Ave? A new fence installed around the orchard has cut off the old access that the community used to access the river and trails.

Apparently the people who bought the orchard put up a fence and blocking beach access was an unintended consequence. The neighborhood is circulating a petition to have a gate put in. There are legal issues here but case law seems to be on the side of the neighborhood. Hopefully there will be a resolution before next summer.

I live in the Drake neighborhood, and it was quite traumatic for many neighbors when the new owner put up the fence. I (as well as many people in the 'hood) frequented this wonderful open space at least twice a day. Our dogs had a place to run free. Supposedly Marlene the new owner didn't intend to cut off full access, but some squabbles w/ other adjoining landowners forced her to completely close it off.

The petition circulating claims there is a prescriptive easement, and as such, there should be permanent access to the river. My own personal opinion is that there is no prescriptive easement here, unlike the prescriptive easement on Northern. I still walk up there everyday, and each time I see the fence, my heart breaks (it's been 3 months now).
Marlene, sadly, is within her legal right to fence off her property. :hmmm:

The owners of the houses at the end of Drake (Southern) do not want any anyone trespassing on their property, especially w/ their dogs. I would not suggest trying to trespass.

Currently, the final result is that there is no longer access to the Korbel beach.:(: This is also true for wildlife in the area. Since the fence was erected, I have seen deer stuck in the fence, fox running down our neighborhood streets, and 'scat' of unknown source that I had never seen before in the 10+ yrs that I've been going there.

The orchard and river access was something that so many people took for granted. It's a shame, but that's change, and we have to accept it.

Well , before the water comes up, you are welcome on the beach anywhere below the high water mark just for being Californians, perhaps even Americans, not sure how the law goes.
It's jus"how to get there?" boating is an option,,, do you have any rich
winery owner friends who could drop you off there by helicopter??
that might be fun, and would certainly highlight the need for a trail!
On a more serious vein, I know at Sea Ranch, locals got beach access when developers came in and thought they could make everything "private"

You or someone involved with this might consider contacting the county District Attorney about this situation. They have an "ask the DA a question" line concerning legal issues involving regulation and the like. They've been helpful for me.

If the local wildlife is suffering negative consequences as a result of this fence, then it is time to advise the county humane society or animal welfare agency and get their help.
