HI folks, anybody out there ever written up a sublet agreement and have suggestions about what to put in it? I am open to suggestions from all the folks in our community who have subletted their place for months and know what to include in an agreement and how to state it! Please send your suggestions my [email protected] want this arrangement to be the best and the clearest for all parties involved. THANKS

Recently sublet to crazy woman (literally a 5150 according to Sheriff's Dept.), and learned the hard way that any sublet agreement from tenant to subtenant is NOT recognized as being valid in Sonoma County. All persons residing in a rental must have contract with owner, so you would have no recourse if something should go amiss. This is not true for Marin, SF or Lake County. In order to remove sub-tenant, the landlord (owner) of property w ould have to evict all persons.

In my case, I had to pay $900 to this woman to get her to move on, after many calls to Sheriff, made by her, with false claims of mistreatment. Found out she does this regulary as a way of making a living, and getting free rent.

My landlord was irate at first, but great in the end, even offering help in paying her off, because I had been an excellent tenant for 7 years.

The subsequent new housemate had to submit credit report, references, and paid deposit and half share of house rent directly to landlord.

So you and the landlord would be protected.

Hopethis helps a bit and that you have a reasonable landlord who would ask any new person the same contractual terms as had between you in the beginning.
