"Wahh-mart" fired a very hard working female employee that I am aquainted with. A little background - she has given them her dependable hard working efforts meeting all the crazy shift hours they can throw at her. Most people would have walked off the job. She has weathered those oppressive individual customers. She has weathered uninspiring associates and the chain of command. She did have her gains such as some peer friends, countless satisfied customers and a fair paycheck with good benefits. She was on vacation and on her last couple of days off she was looking to shop at, "Wahh-mart". Then she met up with one of the employees noticing that the conversation was provoking her to walk away. In her haste in the distance she made one of those "thinking to yourself" opinions. So the day she return to work and four hours later her Manager takes her in his office and reproofs her for her "day off" opinion telling her that she is fired.
So even though she made an appology in vain and started having a female moment. Just then instead of letting her clear her mind a bit he had her signing a paper that was self incriminating. She felt that she was signing some kind of usual last day paper and wasn't detailed anything before signing. She said the manager explained afterwards that by signing, it made her out to look as though she made her opinion face to face with the employee she was talking with on her day off. (Puts a whole new light on the subject) it also turned out to be some kind of contract she would not be allowed to come back to work at, "Wahh-mart", or any branch elsewheres.
I have never boycotted, "Wahh-mart", but I think it is time to do so. Firing this woman for a day off activity is absolutely stupid. :hello:

She needs to consult an attorney asap. She can try contacting a local labor union for references; that would be a very good place for her to start.

I'm not an Apologist for Wal-Mart, I've seen several people get fired from that organization over the years, unfairly, from what I knew about it. They tend to be a bit inflexible about "associates'" behavior. It seems to me they get increasingly inflexible about it the longer a person's worked there without moving beyond floor salesperson. "Associates" are completely, dispassionately, and brutally dispensable for the Wal-Mart machine.
That said, I didn't get the gist of your complaint. You gave no specifics about what you friend said or did. All I could gather from your post is that you believe Wal-Mart asserted your friend said or did something inappropriate while in the store. You apparently didn't dispute that charge. But rather, asserted that it was OK behavior, because the employee did it in the workplace on a day off.
If an employee of mine came to our workplace and acted obnoxiously toward other workers or clients, or intentionally behaved in a way that harmed the goodwill of the company, I would probably fire them too. The fact that they chose to do it on their day off makes no difference.

So Tars just to update you as some time has passed. She was awarded her unemployment funds! . The first denial of her unemployment went to appeal and the Judge awarded her. Wahh-Marts assertion to hinder her from unemployment funds as well as concluding statements from the EDD may have carried some weight but however because of "the nature" of the situation, statements in her favor are in the books! Sorry to say it's a slap in the ole employer's ego and it's educational besides.
