What a roller-coaster it has been this week! Many of us are celebrating the recent major rulings by the SCOTUS--wha--hoooo! But please don't forget the loss our nation suffered earlier this week when our "representatives" voted to support the TPP.

The TPP has been called a trade agreement, but it is far more than that. One of the most insidious provisions is the Investor-State Dispute Settlement (ISDS) system. According to constitutional law professor Alan Morrison,

a new legal analysis (https://www.citizen.org/documents/Alan-Morrison-ISDS-letter.pdf) reveals that the TPP may also undermine the U.S. Constitution... (the) “investor-state dispute settlement” (ISDS), “improperly removes a core judicial function from the federal courts and therefore violates Article III of the Constitution.”



TPP’s expansion of ISDS would newly empower thousands of foreign corporations (https://www.citizen.org/Page.aspx?pid=4083) to bypass the entire U.S. legal system and challenge U.S. laws before private international tribunals comprised of three attorneys. If a corporation “wins”, the taxpayers of the “losing” country must foot the bill. Over $400 million in compensation has already been paid out to corporations in a series of investor-state cases under NAFTA-style deals alone. This includes attacks on toxics bans, natural resource policies, health and safety measures, and more. In fact, of the nearly $14 billion in the 15 claims now pending under NAFTA-style deals, all relate to public health,environmental, energy, financial and transportation policy–not traditional trade issues.
