Shannon Kennedy, Eckert’s attorney, explained that after law enforcement asked him to step outside of the vehicle, Eckert seemed to be “clenching his buttocks.” To the officer, this meant that he should have his rectum inspected for contraband. That’s right, it didn’t mean “perhaps this guy has to go to the bathroom,” or “maybe he has some sort of medical condition”, or maybe even “I might be looking at him and making assumptions.” No, to the law enforcement officer, this was deemed probable cause to inspect Eckert’s anal cavity for narcotics. Even more absurd, a judge agreed with them and issued a warrant that permitted an anal cavity search.
Deming Police tried to take him to the emergency room for the search when he refused their advances, but doctors there refused to perform it, stating correctly that such a search was “unethical.” Physicians at the Gila Regional Medical Center in Silver City, however, had no such Hippocratic qualms, and agreed to perform the procedure. ...
